Okay, now they have done it.

I am not sure, which thing has got me to the place when I can no longer be quiet, and polite. This Great Grandmother, is up in arms. No, Patriots, don't be alarmed, it is always worrisome when activists, warriors, scared people, are angry. When grandmothers get up in arms, she does not need guns...She is the guns. 

Our words, experience and wisdom are power. We share knowledge, scar trails, and usually some type of a limp. Grandmothers, as a whole, can be trusted. We are the Earth, the Earth is us.



Since I am familiar with Arkansas Department of Environmental Quality (ADEQ) data base, I am going to use different documents to help the average person understand, and grasp the importance of citizen involvement. Residents in the know, have more say in what happens to their Natural Resources, water supplies, soil, air, and toxic storage events. The permit processes is lengthy when there is a lot of involvement by citizens, environmental, and human rights groups. Attending public meetings,and responding to public notices about Environmental Permitting is a duty we all share. If I do not live off of the land, but use chemicals, gasoline, tires, aerosol cans, computers, internet, or medicine, I am a consumer.

 If I consume, I am responsible for waste and pollution that comes with manufacture, 

If I drive a car, I am responsible for oil spills, and other energy borne disasters. 

If I use natural gas, I am a fracker. 

Arkansas is in Region 6, of the Environmental Protection Agency (EPA).

Arkansas, New Mexico, Louisiana, Texas, Missouri, and 66 Tribes comprise Region 6. Region 6 of the EPA is the Federal Branch of the Environmental Protection Agency. As is with our nation, there is a separation of powers between Federal and State. Each State, or Tribe has an Environmental Agency at that level. 

The Federal and State Agencies, are supposed to be on the same side, but when it comes to the mechanism of business, regarding the Compliance with Federal laws, States will often wag their powers around, stirring up a Judge or another Agency, who is invested in the same Corporations as themselves. The Feds do not want to have to bring down the National Guard every year to get Southern States to comply with Federal Law, so a third party comes into play, the People, or the Public

Region 6 is notorious for inviting big polluters to set up shop, and helping them all they can to get permitted and in operation. One would agree with these judges and governors and senators, that it is healthy for the economy, to have these industries, even if they sling toxic by-products, poisons, acids, chemical weapons, nuke juice, you name it. 

The worst thing is, that the long run is a sadly losing situation for all near-by residents. Neighbors suffer anything from massive cancer rates, to stillborn children, dead crops or livestock, Asthma, tumors, deformities. It takes so long to prove the causal affect between polluter, and victims. 

Promised jobs are held by people from other States where 70% of their populations aren't on disability, brains work like they should. They will hire a few locals to do the grunt work, but again, in the long run, the medical costs, loss of in-put from the sick, depression, and bankruptcy, is not economically positive at all.

The few fat cats, and their cousins, fill their pockets, keep their attorneys in Gucci leather, and eventually abandon the whole shit load onto the citizens of the place where they basically robbed the citizenry of peaceful enjoyment, and the right to seek happiness.

No man is an island, and Earth is not the center of the Universe. If Earth is the center, and most crucial portion of the universe, then we are all in big trouble. 

Being human, requires us to be considerate of all life around us. It seems odd to me, that people who say they are God-centered, do not respect this planet or our universe. Life, Earth, and the Solar System, is all just some unexplained, unseen "down there," or mysteries gold mansions, and pearly gates "up there". This from religious zealots who cannot stand to give science a look, because they are afraid of fact finding. 

It was not until well past my fourth decade of life and learning, did I realize the enormity of systems at work from the hand of some life giving force. When majoring in Geology / Environmental Geology at the University of Arkansas, at Little Rock, AR., I had to look at the enormity of the Biosphere, and at minuscule particles, gases and liquids that are the tiniest pieces of everything made - including Human Beings.  

It was difficult to wrap my mind around at first, but as I "got it," there was enough new scientist about me, that I began to question some of the theories created around the Geo-physical principals we accept and subscribe to. 

No longer in college, my study of the universe has continued with a passion. I am re-forming theories I once believed, and am now asking questions, and am actively seeking answers. My thinking is that the entire universe is connected. That the Earth is just one small part of the entire body. It should not seem strange that with how vast our universe is, there should be many planets, moons and stars that contain sophisticated life. 

It is not illogical to consider that the natural healing systems, and anti-bodies within in us as humans and other critters, apply to planets and atmosphere's too. It is my learned opinion is that the box we humans have Creator stored in, is much much larger than we can even imagine; it surpasses what we understand in time and space measurements. 

I hope you enjoy this post, and keep in mind, our universe could have been exploded millions of years ago, and we haven't gotten the memo yet. Just a theory mind you, just a theory.

EPA Warns Against Use of Refrigerant Substitutes That Pose Fire and Explosion Risk

The Environmental Protection Agency (E.P.A.) released warnings regarding the use of refrigerant substitutes that pose fire and explosion risks.

Many homeowners are barely scraping by these days, and those who are forced to rent or lease substandard homes, are faced with having to replace air conditioners and refrigerators with HCFC-22 (R-22), which is very expensive, and only sold under strict rules. R-22, has been banned for many uses, as has propane. There are only a few instances where R-22, or a substitute may be used, and it is never approved for individual use.  

There have been many explosions, fires, injuries and death due to the uses of substitute refrigerants, such as R-290, 22a, 22-A, R-22a, HC-22a, and CARE 40. 

At this time the E.P.A. is investigating cases where propane has been marketed and used as a substitute for HCFC-22 (R-22), a refrigerant that is widely used in home air conditioning systems. Home air conditioning systems were never made for propane and other flammable refrigerants.

What Is A Good Alternative To Propane Based Refrigerants? The E.P.A is currently researching to find safe and environmentally sane substitute for R-22, but at this time there are none. 

Part of the problem with many refrigerants is that they deplete the Ozone Layer. 

A number of refrigerants with “22a” or “R-22a” in the name contain highly flammable hydrocarbons, such as propane. These refrigerants are being marketed to consumers seeking to recharge existing home and motor vehicle air conditioning systems that were not designed to use propane or other flammable refrigerants. These refrigerants have never been submitted to EPA for review of their health and environmental impacts and are not approved for use in existing air conditioning systems

I know it's hot out there, and this is a perfect time to find alternatives to piped air. It has become too expensive to heat and cool, for many individuals and families.

Although freezing air was a great idea at its start, it is like so many other things that has come through the Industrial revolution that seemed like a good idea at the time, but what was not considered were the consequences or trade-offs for such luxury.

What is a Watershed? Adopt Your Watershed 2012 EPA Program announced

Today, those of us who are concerned with Mother Earth, and all of her inhabitants, have many causes we can adopt, many organizations who are doing good things to keep Earth, Air, Sky and Waters clean. 

There are a handful of organizations that I support in Social Media that are strictly for the preservation of birds, four-leggeds, fish and all manner of critters. 

For those who are straining at the brain trying to figure out where to put our energy and time, it is difficult choose one thing, and many of us do not. 

What is a Watershed? (Follow link to EPA Watershed Page) We all live in a Watershed. A Watershed is an area where all waters run to a common waterway. This includes the smallest streams, creeks and tributaries, all the way to our globe's Oceans. We all have a vested interest in strengthening, and caring for our Watersheds.

It is a good time in 2012 regarding young people, because they are looking up from their !Pods, Smart Phones, and Blackberries; not liking what they see. They are getting involved, and here is hoping they surpass us old school environmentalists, who fought in the 1970's to see the creation of the Environmental Protection Agency.

It is 40 years since the Clean Water Act was established, and it has helped, but industry and an Industrial brained Congress, have caused many loopholes in the Clean Air, and Clean Water Acts. The Industrial wires say that Environmental Regulations hurt business.

 That is only a lie. It is greedy old dudes wanting to not only win a few games, but they want it all. 

Even mine and yours. Me, my children, grand and great grandchildren have the right to clean Air, and Clean Water. If rules against destroying what keeps us alive are burdensome, then perhaps the Industrial Wires need to rethink their positions.

Having said all that; The Environmental Protection Agency (EPA) has a program that will give groups, communities and Tribes a way to Adopt one of 2600 Water sheds in the U.S. and Tribal Nations.

This is exciting, because community members who care enough to give a little time each month, can make a huge difference to their own Watershed.

EPA Partners with Dept of Energy for sustainablility

The Environmental Protection Agency (EPA) has partnered with the Department of Energy and come up with a Division that will be administered through the EPA: "Land, Waste and Cleanup I Science & Technology"

The EPA and Department of Energy are running feasibilty studies that will work on producing energy by coming up with ways to transform polluted, National Priorities Listed Properties, Toxic Waste sites, mining sites, and Brownfields.

This is a link to EPA Podcasts that talk about Green Innovations, and are an alternative to having to read through these government announcements, giving the non-scientist a chance to participate and gather information for Environmental equality.

The #photo centered above was taken from the 2nd floor of the Clinton Presidential Library, on the banks of the Arkansas River, in Little Rock, AR. The reason I used this photo is it shows current activity in revitalizing the North Little Rock, Arkanasas side of the Arkansas River.

What does that photo have to do with the EPA Science & Technology of focusing on Waste sites, Brownfields and other toxic lands to move toward a renewable future? The Clinton Presidential Library Foundation, and Heifter International partnered to Revitalize a National Priority Listed Property area of the Arkansas River bank, and it is one of the most successful set of greening and revitalization projects to date.

There is a lot of good information, laid out in a simple manner, and there are links to a lot of information for the citizen who wants to get involved in Public Comments, and attending Public meetings. The Land, Waste & Cleanup site, is an excellent page for resources needed for those seeking information on environmental issues by and near their homes.

The industries are the ones who show up to the public meetings, and are involved in decision making meetings when it comes to permitting facilities and business. Be Involved, show up, and speak up.

I have been playing with this Interactive Tool; RadTown, it is very user friendly. The first thing I clicked on was the Nuclear Plant Stacks, and when I did, it gave me a brief summary of what a Nuclear Plant is, and what they do with their radiation.

When clicking on the Construction Site, I found they have listed the device I used to transport and use in testing. The brand we used was Troxler, and it contains uranium, and measures the moisture and density of the ground/road/rock. One must be trained and licensed to transport a Nuclear Gauge. Several of these come up missing each year.

There are many other areas to check. I hope this helps bring a better understanding of what using radiation in our everyday lives cost us. 

All of the items listed in RadTown, are best case scenario. This is the problem with business and industry. They come up with an idea, which seems very cool at the start, but when looked at in the long-run, it is a crap shoot. Radioactive Waste, Accidents. and spills are a payoff we cannot afford. 

What happened to the spent fuel rods at the Grand Gulf Nuclear Plant, when Katrina hit? Since NRC (Nuclear Regulatory Commission) only answer to themselves, this is a question I have long been afraid to ask, and have answered, but we need to know.

On Thursday of this past week (02.10.11) the U.S. EPA notified five (5) companies that they would no longer be allowed to claim the compounds and/or ingredients of their chemicals are confidential.

For decades Congress has assisted large industry in pouring toxins into our air, water and soils, all the while, not required to notify State or Federal Agencies of the chemical compound ingredients, testing, and dangers. 


The very fact that Newt Gingrich was calling for the dismantling of the EPA last week, shows that there was a lot of pressure from those who have purchased the US Congress, lock-stock-and pork barrel. 

When the public gets a load of the ingredients that have been used in the manufacture of chemicals, there will be a barrage of law suits, because the affect on human health, is one that is over 50 years old. 


Thirty years ago, the EPA was created, because Oil and Auto manufacturers built their empires around crude oil, laced with lead. Our atmosphere was cooling at that time because there was huge parts per million particulate of LEAD! Hello. When we first were activists for an Agency that would regulate polluters, the same lies were spread then as now. The auto industry said they would go under if lead were removed from gas. 

Oil companies said it would cost them way too much, they would lose money. Industry would suffer. The same happened when more safety was required for automobiles, and human safety. Any person who has been a member of Congress over 30 years, has mostly aided and abetted huge industry and polluters. It is proven that dirty industry causes more poverty, sickness and lower quality of life for the majority where they operate. 

Jobs are given as the carrot in front of the jackass, those jobs are temporary, and stressful and usually dangerous. The high level jobs held by a mere handful in comparison to the regular worker is apples and oranges in pay and benefits. For decades coal mining denied that breathing coal dust was unhealthy for workers. The fight to prove the damage to human health took almost a century. 


Now as retribution, coal companies simply strip the mountains off the land. Kill the streams and creeks, and pay their little fines. The final act is when they are allowed to abandon their properties, that they have injured and killed. Leaving populations and towns evacuated. 

The kicker is that our US Congress has made tax credits available for those who abandon their industrial disasters. Under the Superfund program, Industries used to be responsible for funding the superfund trust fund, but thanks to the Congress that US Citizens have placed in office, Businesses get off scot free, in the scope of things, while the Federal, local, and State governments are left with the cost of maintaining them. Those governments are funded by Citizen Tax Dollars!




The maintenance includes and is not limited to hiring the same engineering firms who helped these industries get pollution permits, to test month after month, year after year, turning in b.s. pollution monitoring reports that are mostly b.s., because that is what the owner says it should say. These costs, and the cost of having our human DNA affected by what is allowed to be poured into our very rivers, land and air. 

Thank Goodness for Administrator Lisa Jackson, for bringing transparency to the public from those who have hidden behind Congressmen and women who are only in place to do their bidding. The jobs and economy provided by dirty polluters is a wash. We must get back to basics and take care of our one and only habitat.

On January 13, 2011, the EPA in conjunction with the President of the United States and the Department of Justice have made a FINAL DETERMINATION in regards to the operating permits once granted to the owners/operators of the Spruce Mine #1 

Spruce Mine #1 operations has been out of compliance since they turned in the information on their permit application. They did not tell all of the toxins and gases and metals they would be pouring into the open waterways of Logan County, West Virginia. 

I heard the Mine-Senator Manchin on WDTV 5. "...absolutely wrong, after going through all this permitting them, process...callous" err Senator, I heard "...no investment". Who cares about the health of my Earth that you are callously making profits on, and the health of your Constituents who have highly toxic water, because when your friends at the mines greased those 404's and 404(c)'s, especially when phone calls are placed to the Environmental State Agency, and heads will roll, if they don't get those permits...

• March 26, 2010 EPA-RO3-OW-2009-0985 to withdraw permits for disposal into open waterways(link to document) Between the March 26, 2010, and April 2, 2010 decisions by the EPA, there was one 30-day comment period. Then from April 2 2010, then extended to June 4, 2010, was a 60 day public comment period. As of April 20, 2010, the entire world was focused on the largest known environmental disaster ever. During this time, it was difficult to get the public to respond, but many did.
• March 26, 2010 News Release: WASHINGTON – The U.S. Environmental Protection Agency (EPA) today announced its proposal under the Clean Water Act to significantly restrict or prohibit mountain top mining at the Spruce No. 1 surface mine in Logan County, W. Va. Spruce No.1 mine is one of the largest mountaintop removal operations ever proposed in Central Appalachia. The project was permitted in 2007 and subsequently delayed by litigation. The Spruce No. 1 mine would bury over 7 miles of headwater streams, directly impact 2,278 acres of forestland and degrade water quality in streams adjacent to the mine.

• January 13, 2011 FINAL DETERMINATION  This was not a shock, nor sudden move. The environmental degredation has continued since the permits were first issued, they have been warned time and again, to change the way they chose to operate within the same environment we all have to live in.

According to the news sources who are bought and paid for by big energy, it is a joke, how they are whining about jobs and investments. The jobs would end soon anyway, because they have about used up every resource imaginable. The permits were gotten without full disclosure and with the help and support of the Corp of Engineers, who overseas the waterways of West Virginia. It is hard to dismiss the fact that in order to get the oversight agency to comply, they had to be bypassed. It is very difficult to go against such power, concentrated in such small areas. Their reach is enormous, but the destruction of our habitat must stop. Coal power is dirty, and everything done to harvest it is deadly and detrimental to our environment and human health.

To quote one of the documents; the first filing on the federal register...

Applying the lessons of the past, we now know that failure to 

control mining practices has resulted in persistent environmental

degradation in the form of acid mine drainage and other impacts that

cost billions to remedy. While the Surface Mining Control and

Reclamation Act (SMCRA), the CWA, and other laws have put in place

controls addressing some environmental impacts, including acid mine

drainage, recent studies and experience point to new environmental and

health challenges that were largely unconsidered until more recently.

We know the regulatory controls currently in place have not prevented

adverse water quality and aquatic habitat impacts from other surface

mining operations. We also know the same types of impacts as those

anticipated from this project have had previously unforeseen

environmental consequences.

Public health issues surrounding the types of impacts associated

with the Spruce No. 1 project are not well understood. EPA has been

presented with household-specific and anecdotal information that

suggests individual and possibly public surface water and ground water

supplies could be adversely impacted by surface coal mining activities.

In addition, recent published studies directly relate intensity of

surface mining activities within Appalachia to degraded public health

and mortality. EPA has been presented with a petition from a variety of

local stakeholders that outlines many of these concerns and further

relates them to issues of environmental justice.

• The press, is not saying is the history of non-compliance of strip miners, and mountain-top miners.
• Anyone who could do that to a mountain, does not care about nature. 
• Vetoing of the 404c and 404 permits once issued to Mingo Logan Coal Company, working reclamation of Spruce Mine #1 Surface Mine is due to a long legal battle that Coal money has kept going. Environmental Justice had one victory here on this day.

Thank you Lisa Jackson, and all of the citizens who refused to stop, when the cause seemed impossible. 

"Facilities Across the Southeast Ordered to Stop Discharging and Comply with Clean Water Act"

Facilities in States of EPA Region 4 Ordered to comply with the Clean Water Act (link)

Region 4 Covers, Alabama, Florida, Georgia, Kentucky, Mississippi, North Carolina, South Carolina, and Tennessee. It is also the home of six Native American nations.


On January 13, 2011, the EPA announces a stop discharging notice. All of the States involved in this are  

• North Carolina, 
• Tennessee, 
• Kentucky and 
• South Carolina.

Operating in these four States are seven (7) entities or businesses that are under this order. For the time being, the time under this order occurred during the last quarter of 2010. Where there were violations of the Clean Water Act (CWA). That is a very quick action to have happened, and thanks to the Regulators in this case deserve a big thank you.


Three of the entities (facilities, or permit holders) who violated storm-water regulations.

"...polluted runoff is discharged, often untreated, directly into local water bodies. The entities cited and their associated violations include:

 

·         YDV, Inc., for violations at the Compass Pointe Phases 2, 3 and 11 sites in Leland, N.C.;

·         Marion Retail Investments, LLC, for violations at its Grandview Station construction site in Marion, N.C.;

·         Shelby County Schools, for violations at the Shelby County Administration Building in Arlington, Tenn."

All of these have been ordered to stop discharging pollutants, accidentially or on purpose onto the ground, and or bodies of water near their facilities. Each one has contributed to the failing percentage of clean water. 


The concern is that they must stop and make remediation, but it will be up to the citizens of these areas to inspect, or make sure the Government agencies assigned to protect the environment continue to do so. 

It is all fine and well that they have finally been stopped, but how much damage to our entire eco-system does this stand? We must protect our environment. It is the only one we have.

CHICAGO – U.S. Environmental Protection Agency is holding a public hearing on EPA’s proposal to regulate the disposal and management of coal ash from coal-fired power plants. 


"This is the first time the EPA has proposed to ensure the safe disposal and management of this material". Why has the EPA not been regulating the disposal of coal ash/pot ash/fly ash?


 Does this mean the EPA is now going into business with the Coal Plants? From what I understood, the EPA has found conclusively that there is no such thing as Clean Coal, and that the operation of Coal-Fire Plants is not only hazardous to Human Health, but The ENVIRONMENT!!!!!

The hearing will continue past 9 p.m. if necessary. Walk-ins and written comments will be accepted at the hearing. The agency will consider the public’s comments in its final decision. 

Background: The need for national management criteria and regulation was emphasized by the December 2008 spill of coal ash from a surface impoundment near Kingston, Tenn. The proposal will ensure for the first time that protective controls, such as liners and ground water monitoring, are in place at new landfills to protect ground water and human health. Existing surface impoundments will also require liners, with strong incentives to close these impoundments and transition to safer landfills which store coal ash in dry form. The proposed regulations will ensure stronger oversight of the structural integrity of impoundments and promote environmentally safe and desirable forms of recycling coal ash, known as beneficial uses. 

EPA has proposed two main management approaches, one of which phases out surface impoundments and moves all coal ash to landfills; the other allows coal ash to be disposed in surface impoundments, but with stricter safety criteria.

This is already the EPA's job, to regulate the storage and disposal of Coal Ash. These "impoundments" should already have liners, as should the disposal from every other Energy Mining, Drilling, and Fracking operation. 


It is really becoming Lulu world -   

"...impoundments and promote environmentally safe and desirable forms of recycling coal ash, known as beneficial uses..." ??????????

Thank you Pew Project, Thank you Homeland Security, and Thank you EERE. I think you have finally taken the U.S. Constitution and sent it into the last Smoke Stack. This is not Kosher, This is not any good for the Citizens of the U.S. - The poor citizens who will never have Environmental Justice, because it is the poverty stricken towns and Reservations that get these "impoundments, mining, drilling ponds - With the Promise of Jobs and security - This is Dirty and stinks. 

I think it is too late for Citizens to Make a Difference. I think the Deed is already done. A Three Day notice to come to Chicago, and Come to the Hilton...Citizens cannot afford to pull that off, but by God Industry sure Can!
