CHICAGO – U.S. Environmental Protection Agency is holding a public hearing on EPA’s proposal to regulate the disposal and management of coal ash from coal-fired power plants. 


"This is the first time the EPA has proposed to ensure the safe disposal and management of this material". Why has the EPA not been regulating the disposal of coal ash/pot ash/fly ash?


 Does this mean the EPA is now going into business with the Coal Plants? From what I understood, the EPA has found conclusively that there is no such thing as Clean Coal, and that the operation of Coal-Fire Plants is not only hazardous to Human Health, but The ENVIRONMENT!!!!!

TIME: 10 a.m. to 9 p.m.

DATE: Thursday, Sept. 16

PLACE: Hilton Chicago, 720 S. Michigan Ave.

The hearing will continue past 9 p.m. if necessary. Walk-ins and written comments will be accepted at the hearing. The agency will consider the public’s comments in its final decision. 

Background: The need for national management criteria and regulation was emphasized by the December 2008 spill of coal ash from a surface impoundment near Kingston, Tenn. The proposal will ensure for the first time that protective controls, such as liners and ground water monitoring, are in place at new landfills to protect ground water and human health. Existing surface impoundments will also require liners, with strong incentives to close these impoundments and transition to safer landfills which store coal ash in dry form. The proposed regulations will ensure stronger oversight of the structural integrity of impoundments and promote environmentally safe and desirable forms of recycling coal ash, known as beneficial uses. 

EPA has proposed two main management approaches, one of which phases out surface impoundments and moves all coal ash to landfills; the other allows coal ash to be disposed in surface impoundments, but with stricter safety criteria.

This is already the EPA's job, to regulate the storage and disposal of Coal Ash. These "impoundments" should already have liners, as should the disposal from every other Energy Mining, Drilling, and Fracking operation. 


It is really becoming Lulu world -

Thank you Pew Project, Thank you Homeland Security, and Thank you EERE. I think you have finally taken the U.S. Constitution and sent it into the last Smoke Stack. This is not Kosher, This is not any good for the Citizens of the U.S. - The poor citizens who will never have Environmental Justice, because it is the poverty stricken towns and Reservations that get these "impoundments, mining, drilling ponds - With the Promise of Jobs and security - This is Dirty and stinks. 

I think it is too late for Citizens to Make a Difference. I think the Deed is already done. A Three Day notice to come to Chicago, and Come to the Hilton...Citizens cannot afford to pull that off, but by God Industry sure Can!

This Public Meeting is slated to be held: June 24, 2010, The Public Meeting will be held at the Clarksdale/Coahoma County Chamber of Commerce, 1540 Desoto Avenue, Clarksdale, MS. This Public Meeting will begin at 7:00 P.M.

(In the spirit of fair play and Environmental Justice - I think that is is a conflict of interest to have a meeting this important at the Chamber of Commerce offices. The Chamber of Commerce has always favored industry, and their most recent stand AGAINST Recovery & Reinvestment, and the Health of the People is a Red Flag that Fairness and Justice will not be found easily at this Public Meeting Location.)

When the EPA conducts an assessment of a Superfund Site [or Property listed on the National Watch List Properties], it is at someones request. Sometimes an Assessment is performed to see if any further progress or findings have been conducted on "suspected" Superfund sites. The assessment can cause the property to be dropped off the watch lists. That means what it sounds like.  A company (ies) who caused / left the toxic waste behind abandon the properties, change their P.O. Box, done a New Name, and start all over down someone else's dirt road. They receive a tax benefit according to IRS Tax Law, they get to walk away and barely pay a dime. Not counting the human health effects.

Another reason a Superfund can have an Assessment is for a Brownfield Property Assessment to see if it can be rehabilitated for Human habitation and use. This would mean, an interested Agency or Organization is considering taking on the spoiled property, and work to restore to former or better use.  This coming up meeting will be discussing the future of this property.


In order for Environmental Justice to be served, more needs to show up at these meetings besides industry.

Today's announcement (12-29-09), is regarding the Air Division of the (EPA) Environmental Protection Agency. The administrators are working on the rules for Sulfur Dioxide* emissions into our Air. That is all of our Air. Not many of us live in Bio-Domes, so it is safe to take Atmospheric scientist conclusions, that water travels in worldwide currents. Air currents as well travel many miles. We all share this Air.

Yesterday I blogged about an announcement from EPA asking People to submit comments regarding the rules in the process of the final remediation of dirt containing Dioxides [SFUND 2009-00907]. Remediation being restoring it to it's former use. It must be rendered useful and no longer a toxic filter. A Brownfield of Superfund site usually full of dioxins and must be cleaned up; usually of harmful dioxins are in the soil.

This is the EPA working to do the "Protecting" part as they have been assigned to do. For too many years, these pollutants; S02, Nox, have been allowed in emissions inventories without any limitation in many States. The Southern States of the U.S.have typically allowed the biggest pollution permits, because the Southern States are influenced more by business interests than conservation. The EPA and States cannot regulate to protect human health if they do not get input from more citizens.

The EPA is proposing to make the nation's sulfur dioxide (s02) standards stricter. Presently when a Facility (Industrial Site) permitted, they pay for every ton of pollution that gets through scrubbers and other stacks on their site.

In order to know how many tons they must purchase, they must do "stack testing". The stack test is supposed to simulate production levels of an hour run. Each 6 months, 1 year, or 5 years, permitted facilities who fall under EPA Air Division, Title IV 40 CFR 60.8 must test their emissions; or smoke coming out of their stacks. Because of the chemical processes, it is scientifically measured as to what pollutants will come from their operation.

The new national one hour S02 standard will be 50 - 100 ppb (parts per billion), meaning that in one hour of operating, the tonnage of emissions will be measured for how many part per billion of the released smoke contains So2. The new standards will decrease the allowable amounts of S02 that can be emitted per hour in industry.

It is understandable that Industry will balk and go on about paperwork, extra costs for testing, permitting and consulting. It is expensive and it does cut that bottom line.

I know individuals who work at large facilities. Most are family men that love the woods, rivers and clean air. They are u.s. It is as simple as thinking of a problem in a different way. Change happens, and it can be good.

Please have your say. Get involved. It has been said before; all it takes is for each of us to do one thing. People who come together for a good cause are a powerful force, with many of us out of jobs, maybe struggling to keep our home. We can go to the libraries, search public notices, and show up for public meetings; in letter or person. None of will be sorry for enhancing the Eco balance of our planet.
